Terms & Conditions for GetMy.Link

1. Scope of application

These General Terms and Conditions (GTC) apply to the legal relationship between the online service getmy.link (hereinafter: “Provider”) and the registered users of the platform (“Users”).

2. Services of the provider

(1) The Provider provides users with a platform to create and manage personal or business link pages. This includes:

  • building biolink pages
  • creating shortened links
  • uploading and share files
  • generating QR codes
  • hosting lightweight static sites
  • tracking clicks and add pixels

(2) The provider reserves the right to change, develop or discontinue the offer at any time.

(3) The provider has the right to embed advertising via third-party providers in the services used by the user.

3. Registration and conclusion of contract

(1) Registration is required for use. The user undertakes to provide complete and truthful information when registering.

(2) By registering, the user submits an offer to conclude a contract of use. The provider accepts this offer by activating the account.

(3) Users must be at least 18 years old. If a higher minimum age is required for the use of the Provider's service under the law of the User's domicile, this shall apply. A higher minimum age requirement may also result from the content that the user links to via his provider page.

(4) By registering with the provider, the user expressly agrees to messages containing news about the provider's offer being sent to the e-mail address provided by the user. The user is entitled to stop receiving the newsletter at any time by sending a corresponding email or by clicking on the “unsubscribe” link at the end of the newsletter.

4. Obligations of the user

(1) Users are solely responsible for all content that they post on their link page, in particular texts, links and any integrated media. They are also solely responsible for compliance with all laws in connection with their Provider Page.

(2) Users guarantee that the content is free of third-party rights, in particular copyrights, and may be used and made publicly accessible by them in the specific manner.

(2) The user is prohibited from using the provider's service in a way that violates the rights of third parties, applicable law or these GTC. 

This includes in particular the use of a user name or the selection of the personal provider URL as well as the uploading or linking of content on the user's provider page that fulfills the following criteria:

  • content that glorifies violence, is extremist or offensive
  • Content that violates copyrights, trademark rights, patents or other property rights or personal rights of third parties
  • Phishing, malware or fraudulent content
  • Trade in prohibited items, weapons, drugs, etc.
  • Offering services of any kind without the minimum age required under the applicable law in the user's country of origin or the law of the potential customers or without the required official permits
  • Other illegal content

(3) The user undertakes to keep his access data secret and not to allow third parties access.

(4) In the event of a breach of user obligations, the Provider may, at its discretion, block the user concerned, delete the content and links in question or take other appropriate measures. This also includes the immediate termination of the user contract for good cause (see also No. 7 of the GTC).

(5) The User shall indemnify the Provider against all third-party claims in connection with the User's use of the Provider's services. This also includes the legal advice and prosecution costs necessary in the event of a dispute.

5. Granting of rights

(1) The user grants the provider the simple, non-exclusive right to technically store, reproduce, make publicly accessible and, if necessary, modify the posted content in responsive layouts for the purpose of providing the service.

(2) Furthermore, the provider has the right to display the user's landing page for advertising purposes on its own website and in external advertisements by way of example.

6. Availability and liability

(1) The provider endeavors to provide the service without interruption, but does not guarantee a certain availability or error-free function.

(2) The Provider shall only be liable for damages resulting from a grossly negligent or intentional breach of duty. In the event of a slightly negligent breach of duty, the provider shall only be liable for damages arising from the breach of essential contractual obligations (cardinal obligations), but limited to the foreseeable damage typical for the contract.

(3) The provider assumes no liability for third-party content (e.g. through linked pages).

7. Contract term and termination

(1) The user relationship runs for an indefinite period of time.

(2) Users can delete their account at any time after logging in to the provider in the account settings. This also ends the user contract between the provider and the user.

(3) The provider may terminate the contract with a notice period of 14 days to the end of the month. The right to extraordinary termination remains unaffected.

9. Changes to the GTC

(1) The Provider reserves the right to amend these GTC with effect for the future. Users will be informed of changes at least 14 days before they come into force by e-mail or the next time they log in. If the user does not object within 14 days, the changes shall be deemed accepted.

(2) The provider has the right to make extensions or additions to the general terms and conditions, which are necessary due to legal regulations or which concern new features and services, without the consent of the user. In this case, the provider reserves the right to inform the user of these changes or additions at its discretion.

10. Final provisions

(1) The law of the Netherlands shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

(2) Should individual provisions of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected.

(3) The place of jurisdiction is, as far as legally permissible, the registered office of the provider.
